Owner: BereTEK LLC (“BereTEK”, “Company”, “we”, “us”, or “our”)

These Terms & Conditions (“Terms”) govern your access to and use of LiveChat Pro, a web-based video meeting and collaboration platform operated by BereTEK LLC.

By accessing or using LiveChat Pro, you agree to be legally bound by these Terms.


1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. By using LiveChat Pro, you represent that:

  • You have legal capacity to enter into this agreement.
  • You will comply with all applicable laws and regulations.
  • You are authorized to act on behalf of your organization, if applicable.

2. Account Registration & Security

To use certain features, you must create an account.

You agree to:

  • Provide accurate and complete information.
  • Maintain confidentiality of login credentials.
  • Notify us immediately of unauthorized account use.
  • Accept responsibility for all activity under your account.

BereTEK reserves the right to suspend or terminate accounts that violate these Terms.


3. License to Use the Platform

Subject to compliance with these Terms, BereTEK grants you a limited, non-exclusive, non-transferable, revocable license to use LiveChat Pro for business or personal communication purposes.

You may not:

  • Copy, modify, reverse engineer, or distribute the platform.
  • Resell, sublicense, or commercially exploit the software without authorization.
  • Attempt to gain unauthorized access to servers or data.

4. User Conduct

You agree not to use LiveChat Pro to:

  • Transmit unlawful, defamatory, abusive, or fraudulent content.
  • Distribute malware, spam, or phishing content.
  • Harass, threaten, or impersonate others.
  • Infringe intellectual property rights.
  • Record meetings without proper consent where required by law.

BereTEK may remove content or restrict access if violations occur.


5. Meetings, Recordings & Content

5.1 User Responsibility

Users are solely responsible for:

  • Content shared during meetings.
  • Ensuring compliance with recording consent laws.
  • Managing access to meeting links and credentials.

5.2 Recordings

If recording functionality is enabled:

  • Hosts are responsible for informing participants.
  • Recordings may be stored on BereTEK-managed servers or third-party cloud providers.

BereTEK is not responsible for misuse of shared content by participants.


6. Fees & Payments (If Applicable)

If you subscribe to a paid plan:

  • Fees are billed in advance on a recurring basis.
  • Payments are non-refundable unless required by law.
  • Failure to pay may result in suspension.

BereTEK reserves the right to modify pricing with reasonable notice.


7. Intellectual Property

All rights, title, and interest in LiveChat Pro — including software, branding, logos, UI design, and proprietary technology — remain the exclusive property of BereTEK LLC.

Users retain ownership of their uploaded or shared content but grant BereTEK a limited license to process it solely for providing the service.


8. Privacy

Your use of LiveChat Pro is also governed by our Privacy Policy. By using the platform, you consent to data practices described therein.


9. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted or error-free operation.

BereTEK may:

  • Perform maintenance
  • Modify features
  • Suspend access for security or operational reasons

We are not liable for downtime, data loss, or technical disruptions beyond reasonable control.


10. Third-Party Services

LiveChat Pro may integrate with third-party services (e.g., cloud hosting, authentication providers). Use of those services may be subject to their own terms.

BereTEK is not responsible for third-party systems or outages.


11. Termination

We may suspend or terminate access if:

  • You violate these Terms.
  • Required by law.
  • Continued use poses risk to security or operations.

You may terminate your account at any time by contacting support or through your account settings.

Upon termination, access to stored content may be restricted or deleted per retention policies.


12. Disclaimer of Warranties

LiveChat Pro is provided “AS IS” and “AS AVAILABLE.”

BereTEK disclaims all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free performance

13. Limitation of Liability

To the maximum extent permitted by law:

BereTEK shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits, business interruption, or data loss
  • Unauthorized access by third parties

Total liability shall not exceed the amount paid by you (if any) in the 12 months preceding the claim.


14. Indemnification

You agree to indemnify and hold harmless BereTEK LLC from claims, damages, losses, or expenses arising from:

  • Your misuse of the platform
  • Violation of these Terms
  • Infringement of third-party rights

15. Governing Law

These Terms shall be governed by and construed under the laws of the State of New Jersey, United States, without regard to conflict of law principles.

Any disputes shall be resolved in courts located in New Jersey.


16. Changes to Terms

BereTEK reserves the right to update these Terms at any time. Continued use of LiveChat Pro after changes constitutes acceptance of revised Terms.
